- [S23] TROVE, Goulburn Evening Penny Post (NSW : 1881 - 1940) Tue 30 May 1922, "Gross Assault." MAGISTRATE FINES THREE DEFENDANTS. Arthur John Beck proceeded against Frederick Hewitt, Thomas Sharkey, and William Taylor, before Mr. W. S. Arnott, P.M., at the Goulburn Police Court on Monday for unlawful assault. The defendants pleaded not guilty. Mr. E. F. Thomas appeared for the
complainant, and Mr. T. P. Moloney for the defendants. The complainant, who is an engine driver, gave evidence that he was leaving his home in Mundy-st. to sign on for work after midnight on 19th May, when the three defendants jumped over his fence. Sharkey struck him on the nose with a piece of wood, and Hewitt punched him on the jaw, saying - "I'll kill you, you ——." Witness fell on Taylor, who also hit him. Witness's wife came out and cried—"Leave that
man alone, you're killing him." The defendants then left. On seeking medical attention witness found that his nose was broken and his eyes blackened. Witness did not go out on strike in 1917. He believed Hewitt, who was formerly employed on the railway, did. In answer to Mr. Moloney witness denied that there were frequent squabbles between his wife and the Taylors, who were neighbours. The defendants were given no provocation. "They swooped down upon me in the night like wild beasts," he added. Madeline Mary Beck, the complainant's wife, corroborated her husband's evidence. Witness admitted to Mr. Moloney that she had referred to Sharkey as a "pommy". She had never insulted Mrs. Taylor. Evidence was also given by the complainant's son and Robert Leggett. Defendant Hewitt deposed that unfriendly relations existed between Mrs. Taylor and Mrs. Beck lately. Witness saw Beck on the night in question. Beck refused to apologise to Mrs. Taylor. A fight started between Sharkey and Beck. No one used a stick. Replying to Mr. Thomas witness said the scrap only lasted about a minute. It was a "rough and tumble tussle."' Taylor paid he was awakened by the disturbance, and went out in his pyjamas. Witness had nothing at all to do with the squabble. Sharkey said he asked the complainant to apologise for words used to witness's sister, Mrs. Taylor. Beck refused, saying that he would not apologise to a "pommy — ." Mrs. Beck had used insulting words to Mrs. Taylor, and witness wanted an explanation from Beck. Witness was the only person who struck Beck. Mr. Thomas: Are you one of the famous black and tans? Witness: I was in the military, but I had nothing to do with the black and tans. In reply to the magistrate witness said he was returning from an evening in Grafton-street, when he met the complainant. Elizabeth Taylor gave evidence similar to that of her husband. Mr. Arnott remarked that it was a strange coincidence that the three defendants were there to meet the complainant after midnight. After hearing the evidence of both sides he would believe the complainant and his witnesses. Mr. Thomas submitted that it was a most diabolical assault. He urged that a maximum penalty be inflicted. Mr. Arnott: It is a very gross assault. I'm just considering whether I ought not to send them to gool without the option. Sharkey was fined £15, with £2/14/2/ costs, in default three months' imprisonment. Hewitt and Taylor were each fined £7, their costs also amounting to £2/14/2 each. The defendants were granted time to pay. - [S23] TROVE, The Canberra Times (ACT : 1926 - 1995) Fri 19 Aug 1927, GOULBURN The postmaster at Marulan, Thomas Sharkey, has been committed for trial at Goulburn on a charge of having improperly disposed of certain public monies amounting to £166/4/2 between August 1 and 5. Evidence given before the Goulburn P.M. on Tuesday last was to the effect that Sharkey's
cash was short and did not tally with his records, and that two mail contractors' names had been signed by someone other than themselves on re
ceipts for their month's subsidy. These receipts were obtained by Sharkey. Bail was fixed at £100, with corresponding securities. - [S23] TROVE, Goulburn Evening Penny Post (NSW : 1881 - 1940) Wed 14 Sep 1927, POSTMASTER!S CASE Thomas Francis Sharkey admitted a charge of having fraudulently misappropriated £166/4/2, while employed as allowance postmaster at Marulan. Constable Lee, Carrington Tidswell, and Frederick Creswick, were called by Mr. E. F. Thomas, who appeared for accused, and gave evidence as to Sharkey's good character. Mr. Thomas stated that Sharkey had found fresh employment and was prepared to make restitution. Three well-known Marulan residents were prepared to go bond for Sharkey. "You have apparently had a most excellent character, but you have given it a bad blow by betraying a public
trust," His Honor declared, and added. "Were your character not so good and had you disposed of the money in some reckless manner I would have no hesitation in sending you to gaol." Sharkey was released, but was ordered to come up for sentence if called on any time within three years.
